    There are so many units in the states out there that may (currently) be 40% public but only say…15% is accessible due to the checkerboard pattern of parcels. This would be absolutely a good thing and would decrease pressure a fair amount IMO on the existing accessible parcels of public land.

    All these years and the checker board land owners prohibiting tax payers from entering public land ? Class action suites could be brought by Rocky Mountain Elk Foundation , Safari Club , The National Wildlife Association , Ducks Unlimited , NRA and many more ? These groups together could mount a substantial case against the status quo !

    While the general membership total is driven by the mass $20 – $35 general membership … the majority of the funds collected by these nonprofits often come from the top 10% of donors. I bet the old 80:20 rules is pretty close to actual. This may be why many of these organizations sit on the fence on this issue.

    Look at becoming a member of the TRCP … Theodore Roosevelt Conservation Program. TRCP is truly about public land fishing and hunting and access.

    Scroll down on the TRCP web page and you will see a major effort of this organization is unlocking public lands for improved access.

    The 4 hunters prevailed with the 10th circuits ruling on corner crossing.
    Below is an article on the subject and a copy of the ruling.
    In the ruling the 3 judge panel relied on the unlawful enclosures act for their decision.

    I wondered when an outcome of this would occur.

    As long as you do not touch the private ground, you are not trespassing. Airspace is not private land.

    For some reason I cannot get the link to open. So what did these guys do parachute in :-)? Or just hop across right at the corner? Hard to believe they had GPS accurate enough to do that unless the posts are properly marked, but again I cannot see the ruling or article for some reason.

    There was a survey pin at the corner.
    Iron Bar ranch had put 2 fence posts (1 on each corner of their 2 pieces of property) with a chain stretched between them. The hunters built a ladder to sit on the 2 pieces of public ground and crossed over the chain.
    The ranch pressed charges which the hunters were acquitted of. He then filed a civil suit which the hunters won. The ranch then appealed the decision to the 10th circuit which ruled in favor of the hunters. In doing so the 10th circuit relied on the Unlawful enclosures act. (It’s against the law to impede access to public lands. The landowner relied on that the air above private property is considered private property.

    Thank you Full Draw! Pretty creative on their part. Not sure I would have gone through the hassle of doing that, but good for them and it has set a precedence.

    Those areas look like this. Public is yellow. Hard to believe they were sold that way.

    The checker boarding happened when the US expanded to the west.
    The federal government gave the railroad companies land grants and in doing so they were given every other section along the railroad corridors.
