The silliest thing about it all is it’s a subdivision with 3 lakes and we live with the land owner on the second lake. We don’t own the property, which is what his argument was. I offered to grab the actual owner and he recommended he be in my kayak. Lol he also stated that the land owner we stay with hasn’t contributed to the lake. Come to find out he actually repaired the damn with his own equipment out of pocket since he owns the land to the right. It was causing erosion and he didn’t want to wait on the city.
Seems there’s a lot more to this than what’s on the surface, being you live with a guy, this guy has an issue with, who’s trying to sell some land?
Seems odd all the way around.
Tom SawvellInactivePosts: 9559April 26, 2018 at 5:00 pm #1770739Hey I always carry. Concealed is the only lawful way around here, however.
This makes you double dumb bud, especially if the guy is visibly armed and smells of alcohol. If I had been carrying and had this little blow out I’d have been packing out the minute I smelled booze and/or thought the guy was a bit hot under the collar. Escalating the situation by arguing with him while YOU were also armed makes me wonder if you should have the permit. If no law enforcement smelled alcohol on him then alcohol in and of itself is a moot issue here as you can’t prove anything one way or the other. However, if you were the sober party and the was in fact under the influence its YOUR responsibility to take charge of the situation by vacating property that you can’t prove you had permission to be on. Now if you’d have just shrugged it off and walked away, like someone with real balls would have, the law would have been wholly on your side. Then to say “we’ll be back fishing tomorrow” just tells me that you are the problem here and maybe you should just leave him to his puddle and go back to fishing where you can catch two pound crappies.
basseyesPosts: 2508April 26, 2018 at 5:40 pm #1770745If the ordinance is on the sign, and it says the owner has to be with, you are in the wrong, if the landowner wasn’t with you.
Sorry but a pic of the sign and or the actual ordinance hasn’t been provided yet, and that makes me really question any validity to any of this.
If he was boozed up and driving, with a side arm exposed and harassing a law abiding citizen, that falls on you to call the cops on him before he hurts or kills someone, that responsibility is squarely on your shoulders.
The more that’s being posted, the weirder this is getting.
A boozed up guy….
Carrying a firearm illegally….
Was driving…..
And harassing a law abiding citizen….
Yet you didn’t call the authorities?

My firearm was of course in my vehicle. I wasn’t light heartedly replying to someone saying don’t bring a knife to a gun fight. I appreciate the concern though.
AUTO_5InactiveMendota Heights, MNPosts: 660April 26, 2018 at 5:57 pm #1770751Weather the guy was right or wrong, he was obviously pretty wound up. If he was also carrying openly and smelled of alcohol, it only makes sense to try your best not to escalate the situation–something you did not do. You kept on arguing and cutting him off. The fact that your tone of voice got higher and you were talking fast would also signal insecurity on your part and a guy like that is sure to pick up on it, and would likely fuel his fire even more. It’s not worth it to push the issue with someone you don’t know, especially when you’re not a “local.”
Also, if you were so positive you were right and justified, you should have tried your best to call the police before he does because who is calling can make a difference. All in all, it just doesn’t seem worth it for a few small bass.basseyesPosts: 2508April 26, 2018 at 6:15 pm #1770754You live with a guy who this guy doesn’t like, and you indicate that this isn’t the first issue with accessing this body of water, that sounds like a fun, relaxing place to fish. Life’s to short.

We usually keep to the first 2 smaller lakes. The other residents know us and like us a ton. We pick up a lot of trash on those. With the new purchase of kayaks we were finally able to access the 3rd lake since only the dam is public and the lots surrounding the lake are mostly private or heavily wooded. We were just unfamiliar to him and he didn’t like the resident we stay with apparently.

And after all that…there you have it. Case closed…

What a journey. Glad you rode along!basseyesPosts: 2508April 26, 2018 at 7:57 pm #1770767To the op, what would you have done?
Probably been a little more consciously aware of going through an area a small Jon boat couldn’t go through, into a private lake without legal access, via a body of water that has questionable access issue’s already, while staying with a guy people on the third lake already have an issue with allowing people on without the land owner with, which I’m sure is clear in the ordinance, which has yet to be provided as proof one way or the other.

I would have followed the rules, and not be a total richard. You were in the wrong.
I place little credence in your argument by not acknowledging the sign. Your lack of respect towards a property owner is telling of your snowflake qualities.
You were baiting him the entire time and I give him credit for not opening up a can of whoop ass on you.April 26, 2018 at 8:38 pm #1770774Like the raging redneck and the gun in the title… looked like a lot of someone thought they were “entitled” to something they were not. Notice people asking to post the signage… that won’t happen. Does the sign say anything about picking up trash and then you can fish it ? National news… I get it now… call CNN and David Hogg for some pointers. What I would have done was nothing even close to what you did. Are you a Russian troll ???

basseyes, let it go now. I’m surmising this has been resolved out of court and a settlement is currently being negotiated by each parties attorneys.
April 26, 2018 at 8:49 pm #1770779Wowza.
Im just here to say that I am thankful that I dont live in Illinois. A land of no inland fish. This thread will be deleted by lunch tomorrow. ????

MN here we are blessed with many waters and access is fairly easy to go do what we love to do, fish. That is not the case everywhere.
If what you are saying is correct in the legalities, absolutely fight tooth and nail to uphold your rights to fish it. But, those rights very well could go away at the next lake association meeting. Fine line you will need to follow and IMO when you are simply a visitor with permission, you went way past that line in arguing.
Don’t bite the hands that feed you. And that hand you just pissed off helps feed those lakes. I’d attempt to apologize myself and ask if anything can be done, maybe help to stock it, pay for some shoreline restoration, etc

April 27, 2018 at 7:54 am #1770828let Ingetbrightsen have his way in the legislature and these “private” water conflicts are coming soon to a Minnesota lake near you…

These two posts together pretty much some up exactly what I saw with that video and the fact that the OP came here asking for opinions to some how validate his entitled feelings.
I don’t understand the mindset that people continue to badger someone when there is a disagreement about something. You obviously saw that the man was carrying a weapon, you mentioned the smell of alcohol, but yet you continued to badger him and did not choose to “be the bigger man” and just walk away?
You were looking for attention the whole time, be honest.
You knew before you even dumped that kayak into that lake that you were in for a confrontation and that is what you wanted and that is what you received.
Even if you were in the right (which I seriously doubt), its better to leave right and alive than be dead and right.blackbayPosts: 699April 27, 2018 at 9:23 am #1770841I see these conflicts more and more often these days. People are using kayaks or walking in to small ponds they find and fishing them. Just check out You Tube and you’ll see video after video of younger people getting into confrontations with people. The blame goes both ways. Plenty of “landowners” yelling at people to get off “their” property and plenty of “anglers” not bothering, or caring, whether they can be there or not. In Minnesota we’re lucky that if you can gain legal access to a water body then you can fish it. Be respectful, clean up after yourselves, park intelligently…
FWIW I’ve never seen a fish that has been worth getting in trouble with the law or hurt over.

Clearly you’ve never seen a Green Sunfish.

Not sure if they have Green Sunfish in Illinois.basseyesPosts: 2508April 27, 2018 at 12:54 pm #1770882Know we’ll never see it, but would be interesting to see what the sign says.

It’s just a standard no trespassing sign but it’s on a lot. It’s for the lot. The person we have permission from is the one who put it up. I have screenshots of texts of the property owner saying he doesn’t even live out there and that he’s the one causing problems and such and that I have permission and on and on. I’ll be returning Sunday and would love to post a photo of the sign.
