    If what he was doing is truly illegal and you had permission I would have called the police and let them sort it out.

    I guess I’d have just left. Why get someone fired up that you don’t know? And how does this kayaker know that this guy is wrong? It appears that there are plenty of houses there to stop and ask if fishing is ok.

    Instead of saying they’ll be back tomorrow I think they should spend some time at city hall or in the county records and figure out if the water is open to public fishing. Making assumptions is not a smart thing to do.

    If you are legal, why not let him call the cops and let them sort it out. That should end any controversy either way.

    If the ordinance doe, in fact, state that you must be with a consenting landowner to be there, then it seems like maybe the guy (even though he was a little rough) has decent grounds to be ticked – and perhaps you were lucky that he didnt call the cops?

    What really gripes me is that the dorks’ in the kayaks actions reflect on all of the fishing community. The guy has posted that he and his wife have waters available where they catch HUGE crappies, why create a flap that stains the others who don’t play this game?

    Why continue to argue with the guy? Really does no good except escalate emotions. Instances like that it does not matter who is right or wrong until something goes horribly wrong.

    Being I was leaving I would have stated I had permission to be on the lake and tell him I will ask the land owner I got the permission from about the rules of the sign, end of conversation.

    x2. Sometimes, even when you’re right (and I don’t really know who was in the right here), you just gotta drop it and let the other person win. Why continue to “poke the bear”, especially when the guy makes it plainly obvious that he’s carrying? I’d never put myself in that situation.

    It’s not privately owned. The sign says you must have permission to fish the lots of property owners and that public access is restricted to the dam. Anglers must not impede the flow of traffic. We’ve had police called on us before and they said we were fine. Since we weren’t on a lot they let us stay. This guy thought he’d do his own policing. There’s an Illinois state police officer that’s a family friend that is looking into the matter after seeing the video and even offered to let me film the interaction so be sure to check it out when it’s up.

    If he’s the one flipping the bill for the fish you are catching, catch and release means absolutely nothing. Especially if the ordinance actually does state the owner has to be there with you.

    Seems on the surface you could very easily be at minimum pushing the letter of how the law is written.

    It would be easy to jump down the land owners throat, but what’s the law’s and where’s the plat maps to show ownership?

    Hard to answer a question with so many facts left out.

    With hunting/fishing we always error on the side of caution with land owner rights. Unless you like arguing with a landowner. If your vehicle is on a private road and parked where it shouldn’t be, if I was the landowner, you would be asked to leave once. The second time all your tires would be gone. The third the cops would be called and your opinion on anything wouldn’t matter, the law would figure it out.

    If he was/is in the wrong, you should have called the police hands down, especially if he’s carrying where he legally can’t and is in the wrong as far as the trespassing law’s.

    For me personally, I’d want to know without a shadow of a doubt. And even then, that ain’t worth it over a fishing spot, even if it’s some gray area.

    My old man taught us a long time ago hunting, if you are on someone else’s home turf, law’s can be subject to local interpretation and you will get a lot farther understanding law’s aren’t always the same as local customs.

    Post the actual law’s and plot maps and who legally owns that road you are parked and standing on.

    If it’s public, you should have called him in.

    If it’s private, that’s idiotic to post a video like that or worse yet, putting you and your lady in a situation like that.

    The biggest issue according to the officer is that he was open carrying on public property and smelled of alcohol. Since he can’t prove the smell of alcohol it doesn’t hold much weight but open carrying alone is a felony.

    The silliest thing about it all is it’s a subdivision with 3 lakes and we live with the land owner on the second lake. We don’t own the property, which is what his argument was. I offered to grab the actual owner and he recommended he be in my kayak. Lol he also stated that the land owner we stay with hasn’t contributed to the lake. Come to find out he actually repaired the damn with his own equipment out of pocket since he owns the land to the right. It was causing erosion and he didn’t want to wait on the city.

    Similar events without guns have been mentioned on here before. I remember two in particular on the Croix in Afton and also down stream. It happens when a deranged landowner thinks they own the water in front of their property. They dont.

    This is the issue here. Intruding on grandpas honey hole. I guess the area behind his house is private and he was mad we were accessing it with kayaks. Even a Jon boat would be too large to fit through unless it were thin and paddles manually.

    The only way I will watch a video on IDO that some guy links from his YouTube channel is if he is active in other post other than promoting his YouTube channel. (easy to find out just click on their avatar and then activity.) I am tired of people using IDO as free advisement.
    So I didn’t watch it. But from reading the comments and having things like this come up before. ASK for permission first or questions if you are not sure. No public landing, you better start asking around first.

    I think that so called “redneck” kept his cool pretty well considering the continued badgering he got. Especially when followed down the road with the camera on. You’re lucky he didnt knock you on your ass. Right or wrong, you should have left and let the law figure it out.

    If you pay close attention you’ll see I was parked down the road. Hence getting into my vehicle that was right there. If he would have that would have made everything much easier and being on national news would have been neat. Can’t say I’ve ever been there before.
