    Just a update.

I have been visited by the Sherburne county sheriffs office twice now. Today I expect will be the third. The second visit occurred after I hired someone else to plow my driveway. (my plow was broke) He also plowed some snow into the ditch across the road. I have narrowed it down to being a new plow driver for Mille Lacs county. I’m sure he was handed the manual and told to read it. jester

So if i’m absent for a few days it will likely be because i’m locked up in Elk River awaiting bond for the heinous act of plowing snow across the road. mrgreen

I’d be willing to testify as a victim at the parole hearing.

I don’t think I would be eligible for parole. After jumping bail I would get apprehended on the freeway for driving with my flashers on. The good news is………they would need to release a few gun totin’ meth dealers to make room for the “snowplow guy.”

BTW, I will demand a public defender so you can foot that bill also. wink

I Guess I don’t see anything wrong with what happen, I do believe it is a illegal to plow snow across a public road way.

If this is truly the case, don’t you think we have let our local/county governments have a bit too much power? This probably happened because someone pushed their snow across a road and left huge piles of it on the road, which someone hit and maybe got hurt. So the answer is now nobody can plow across the road.

I would keep doing what you are doing. Make certain to clean it up 100% after you are done. Snap a few pictures when done and wait for the ticket in the mail. When you go to court, you now have all of the evidence you need to fight the ticket. Ask the judge, respectfully of course, what you are to do with the 20 cy of snow that was deposited by the plow truck at the end of your driveway. Chances are, the ticket gets thrown out, which will set the future precedence for local law enforcement to act. Eventually, if enough people do this, the law will be called into question and likely ignored or possibly removed from the legal books.

This is a great example of when we as the people can stand up and fight overreaching laws of the local government.

The officer is only doing his job. Somebody complains, they have to come out. I could tell he was embarrassed to have to do it. If they have to write me a ticket, they have to write me a ticket. I won’t hold it against the officer for what he has to do because a overzealous snowplow driver turned me in.

“(a) Except for the actions of the road authorities, their agents, employees, contractors, and utilities in carrying out their duties imposed by law or contract, and except as herein provided, it shall be unlawful to:

    (1) obstruct any highway or deposit snow or ice thereon and (b) Any violation of this section is a misdemeanor.”

Not sure how pushing snow across a road violates this?? I completely agree that obstructing the highway by leaving snow on it is a violation. But pushing it across seems to be a different story.

The local government is always asking for the public’s help during a snow emergency. It sure would be nice of them to grant the same assistance to the people that pay their checks.

For years my neighbor has been pushing every inch of his snow into the middle of the culdesac in front of our driveways with his lawn tractor and tiny plow. He can’t plow it ‘up’ like the city plow so it makes the snow mountain double the diameter during a large snow event. They rarely haul the snow mountain away so it gets to be huge. It’s gotten to be a little annoying the last few weeks when I can’t even back a trailer or my ice house in my driveway without damn near getting buried in the snow mountain myself when backing up. Soo, I’ll have to send a message his way somehow. This is the favorite neighbor of mine who’s wife came to the door and my dog (inside my house) growled at her and she called the cops to report an aggresive dog. We’re good buddies. ;-)

Go get ’em he is committing a serious crime. We might become cellmates. jester But, your deal is different then mine. I’m not blocking a public roadway or causing a obstruction. Anyway, I push the snow all the way across the road and into the ditch. I push it further then he plows with the county truck. So the idea that he will hit the piles with his plow won’t happen. Like I said in the original post, I know that i’m wrong. I’ve never denied it. I just think the whole thing is petty, especially after not hearing a peep about it for 20+ years.

Have you considered not plowing the snow across the highway? Just saying, as it seems like an easier solution than all of…this.

It’s not a hiway, it’s a county road. Big difference in Minnesota. This isn’t about being easy………..it’s about entertainment. Kinda like vulger lyrics in a song. You can ignore them or complain about them in the hope the musician makes a better choice next time. grin

Well, sort of. It’s illegal to plow across them either way as you’ve already acknowledged. It might not be a big deal, but it is the reality, same as changes to the hay cutting rules in the ditches last year.
I know when the plows handle the narrow township road that runs through our family land up der in Minnesota they’re more impacted by what is in the ditch than when they’re handling the nearby county highway and just scraping the shoulders. They even tried/started cutting some of the trees at the intersection until it was pointed out that they couldn’t do that because the trees were outside the right-of-way. Those laws can work for you too…

The way I look at it, it’s a “letter of the law” vs “spirit of the law” thing.
