    Very accurately stated. This is exactly how most CO’s will view targeting a species out of season.
    In a very similar case here in WI with Lake trout on Lake MI. There is a closed laker season here and you will catch them regularly while fishing for Browns. In the spirit of the law, its ok to catch a couple as incidentals. But if you continue to fish the same area, same bait, same technique, and continue to catch laker after laker; then the warden has a clear case.

    Should they also ticket you for using a smaller bait?? Maybe your targeting walleyes below the slot limit?? If you used a larger bait, your less likely to catch the smaller ones….

    Now that was just food for thought. With the government getting soo large… Where does it stop?

    Anybody recall how the courts/CO’s viewed the fishing scenario in the spring ( before walleye Opener and before the walleyes were legal on Upper Red–when the newly stocked walleyes bit like crazy while everyone was crappie fishing? That’s what I thought…

    “Intent” has to be proven by the court’s beyond a reasonable doubt–not by the angler–no matter how or where he or she is fishing. Until you reduce a closed season fish to possession….???

    Again…I am NOT advocating any bad “intent”–just sayin’.
