    I have had it happen to me also. While I was working at a local gun shop, I had a trace come in from a gun I purchased there a few years prior. I sold the gun locally to someone I did not know and that gun was recovered at a crime scene. I got a phone call on my personal cell from a local PD a couple days after I sent the information in. I copied and emailed them the information I took down when I sold the weapon, much like BK did. She thanked me and I went on my jolly way.

    Side note, since this thread seemed to deviate.

    When someone says that there isn’t a tracking record of firearms, they are slightly mistaken. I will tell you for certain that any gun you purchase from a gun shop can be legally tracked back to you. It may take time, but it can be done. Dealers report serial number sales to the ATF, omitting the buyers name after the sale has taken place. They use those records to find where the gun was last purchased and request a trace from the dealer it was sold from.

    Only time it gets blurry is when the gun was legally sold by the user to a fellow resident of the state they reside in, like the case here. That number is very low, but I guess you could call it a “loophole”…There is no requirement to record the information of the private sale, it’s just good practice to CYA.

    EDIT: just so the internet is aware, I sold all of my firearms and do not believe in ownership…

    Not really much else you could have done. Straw purchases are illegal, but how do you as a seller prevent them? Would have just as easily have happened at an FFL as it did for a private sale. You did more than the law requires to document the sale.

    Not taking a shot at you Randy and I’m sure you know that. You just happened to type the story. It seems that we put too much effort into trying to save people from themselves. But we will do it because that’s what good honest people do. I’ll stop now as I’m rambling. Lol I think you know the point I’m trying to make.

    DT, that’s not a shot, its stating reality. Very true, when you genuinely care about people and others, things like this bug you. Not always the individual, but the broader view off all the innocent people that are affected.

    I’m late to the game here but I thought is there a law that said if you sell a gun private party to private party (totally legal) but it is used in the commission of a crime within three years of sale and you didn’t do a NICS check you could be held liable as the seller. Was it just for pistols and “assault weapons?” Did I totally make this up? I’ve never sold a gun so not a huge concern of mine )

    I should’ve clarified. I believe you’re correct that we don’t have access. I meant doing private to private sale at an FFL dealer and running the check. I’ve been asked to do that by someone I bought a gun from and have no issue with that. Peace of mind for the seller and I would ask the same.

    Certain states may have their own laws in regards to this, but MN is not one of them.
