HEARING AND
ORDER FOR PUBLICATION
On October 31, 1991, the Department of Natural Resources (Department) issued a marina permit to Trenton Island Marina, c/o Paul Hayden and Duane Ferguson, N671 825th Street, Hager City, Wisconsin, 54015. On September 4, 2009, the Department issued an amendment to that permit. On April 13, 2010, Trenton Island Marina applied to the Department for a second amendment to the original marina permit to extend an existing pier finger thirty feet waterward in order to accommodate a larger boat on the bed of the Mississippi River – Pool No. 4, located in the NW 1A of the NW 1A of Section 14, Township 24 North, Range 18 West, Town of Trenton, Pierce County.
On May 27, 2010, the Department denied Trenton Island Marina’s permit application to amend the original marina permit.On June 18, 2010, the Department received a
request for contested case hearing from Paul Hayden on behalf of Trenton Island Marina. By letter dated August 6, 2010, the Department granted a contested case hearing pursuant to Wis. Stat. §§ 30. 12(3m), 30.209 and 227.42.
On May 25, 2012, the Division of Hearings and Appeals received the Request for Hearing from the Department of Natural Resources.
NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a public hearing pursuant to Wis. Stat. §§ 30.12(3m) and 30.209 12:45 p.m. on August 2, 2012, in the County Board Room at the Pierce County Courthouse, 414 West Main Street, Ellsworth, Wisconsin.
The hearing will be a Class 1 contested case pursuant to Wis. Stat. § 227.0 l(3)(a) and the fair play provisions of Wis. Stat. ch. 227 will apply. The procedures relating to contested cases set forth in Wis. Admin. Code ch. NR 2 will be followed. The procedure that will be followed at the public hearing will closely resemble that normally followed at a court hearing. All parties are advised that they have the right to seek the aid and assistance of legal counsel and to be represented by legal counsel at the public hearing.
