Music on YouTube Home Videos

    I recently made a a video with footage from our past sturgeon trips and set it to music I had in my iTunes. I haven’t uploaded it to YouTube or anywhere else yet, but I was concerned about copyright issues with the music I’m using. I’m using a Brad Paisley song etc…

    Is this something I should be concerned about? Obviously I won’t be profiting off of it but that probably doesn’t matter. Just curious if anyone as run into issues with this.

    Youtube will pull the music from the video, or the video, if they feel that it is infringing on copyright. I had the issue with some videos I uploaded. I found a number of sites on the web that have free, public domain music thats available for videos which I now use for my hunting and fishing videos.

    I had some vids pulled. They will send you an email with the reason. No big deal if you ask me. Put it out there and see if it flies.

    YouTube also has thousands of songs you can use in your vids.

    I am pretty sure you can add that song to the video and it will put a link to buy the song (on itunes) from your video and then it is ok. Not sure if they still do that but I have had it done to mine in the past. Also, I assume you don’t plan to monotize (put adds on) your video. This is when they pull videos, if you monotize a vid with a copywrited song.

    I think you are fine with no adds and a copywrited song, but don’t quote me on this.

    IMO it’s not a matter what you can/can’t get away with. Bottom line is music created by someone else is under copyright and you should not use it without permission.

    By using music in a video, you are creating an unauthorized copy of that music. The creator of the music holds the copyright and the right to determine who uses it and for what purpose. They also have the right to get paid for its use.

    I know it seems like no big deal with a highly successful recording artist, but put the shoe on the other foot for a second. What if some tackle manufacturer liked your video so much that they copied it off of YouTube and used it in their latest ad campaign? Even if they put some fine print blurb giving you “credit”, how would you feel?

    Contrary to popular urban legend, copyright is copyright. The use, commercial vs non-commercial use, etc doesn’t matter. If you didn’t create the work, you need permission to use it for any purposes.

    There’s got to be a line somewhere here. If I post a video of myself catching fish and we have music playing, should I have to worry about the copyright to any music that can be heard? What’s more, what about if I have copyrighted products visible in the video.? If the video pans past the Igloo cooler, the Frabill fishing net, or my IDO hat, I wouldn’t want to be liable for copyright infringement. But how does one know where the line is in those regards?

    Actually, it matters a lot. While not all non-commercial use is permissible under fair use doctrine, unless the use infringes of the market value of the original work it is not likely a copyright violation. As mentioned above, if you’re not attempt to monetize your channel, there’s not likely a problem. At worst, they’ll pull the video,

    I worked at an family entertainment center for a few years and we had a DJ playing music whenever we were open. We had all the yearly licenses and fees to play music (you’d be surprised how expensive it gets just to play music). Some kids decided to film themselves doing what kids do, with our music being played in the background. They uploaded it to YouTube and attached us to it. It was a pretty cool video to showcase our the business as I saw it after it first got uploaded. About a week or two later we go back to show the owner it and it had been muted by YouTube because of the song playing over our sound system. So yes, they will pull anything that “might” infringe on a copywrite.

    I think this is all correct. I know I had a video flagged with copy infringements. I think you get 3 strikes and they’ll dump your account. Just because it gets flagged, it doesn’t mean anything will happen. Nothing happened with mine. I think the label or copyright owner may allow it too.

    Also if the video is private, i don’t think they domanything.

    I found this with one of my videos.

    Ads might appear on your video.
    Copyrighted content was found in your video.
    The claimant is allowing their content to be used in your YouTube video. However, ads might appear on it.

    If you agree with these conditions, you don’t have to do anything.
