MN – Failure to Transfer Boat Trailer Title…

    I bought a boat and trailer, Boat title is ok, but I got stuck w/ Trailer Title.
    Trailer had a lien on it, and Irwin Mortgage was secured party, Irwin Mort was bankruptcy, no way that can contact them. Previous Owner had returned envelope and returned certified letter. After we did title transfer, which all submitted, I got letter from DVS said that couldn’t process for trailer, “This only applies to passenger class vehicle (this vehicle is a trailer)”
    So they need Court Order to release the lien.

    I don’t know what to do, so please someone HELP.

    Go into the DMV explain your situation and be polite! They are very helpful if you are polite to them. My wife used to work at the one in Stillwater and so many people get mad at them and being very polite goes a long ways.

    In MN they can release the lein and give you title after you follow a specified process of contacting the listed lein holder.

    And before someone comes on with the old “register it as a home built”, NO! This is not a get out of title jail free card. You’re setting yourself up for at the very least problems down the road and if you get unlucky you could find the cops waiting for you at the launch with a pair of handcuffs in your size. Keep in mind, you need to be able to SELL this at some time so the issue won’t just go away.

    What you have to do is find someone at a DMV office who actually knows what they are doing. The average counter clerk will NOT know what to do and they will give you wrong answers and bad information.

    My suggestion would be call the MN Department of Public Safety at (651) 297-2126 and get the process from them. Also get a link to a web page where the full thing is explained so you can show that to any counter clerk who tells you you cannot do it.

    From what I’ve heard, the process will take 4-6 months to complete.

    I did but not got luck at all, with 3 different locations. They pull out record and there is a note in their system. They can only process if I have court order

    It sounds to me like you’ll be time and money ahead to just go buy a new (or new to you) trailer and scrap the old one. jerr

    How is he going to provide reciepts or proof of where he got the parts for this homemade trailer?

    Trade or sell your trailer in Wisconsin. I don’t believe we have titles on our boat trailers?

    In Wisconsin owner cannot sell without a clear title on any titled vehicle…not sure about Minnesota..you knew about the problem before purchase…might as well try for the court order and good luck, might be cheaper to buy a different trailer
