Gonna rant a bit…
I can’t believe the lack of respect so many people in that area have for private property. I can only imagine how frustrating this must be for you Bob. I’m ticked, I can’t imagine how you feel. These guys are not hunters and they are NOT sportsman.
What I don’t understand is how this seems to be a long standing tradition in your area. Nelson’s have caught trespassers this year on a couple occasions. I’m certainly NOT trying to tell you guys what to do, BUT in my opinion the next time you catch someone I would prosecute them to the fullest extent possible. If that doesn’t keep them away, I’m all for an old school lesson. Self defense sounds about right, someone entered your property carrying a weapon… OK, so that was tongue in cheek, but man what a bunch of hooey this is.

December 16, 2011 at 12:45 pm #116855There is a distinct difference between being lost, mis judging the boundry line of public/private land and entering the CENTER of someones property. Kooty, agree with your thoughts very much on this. Trespassing is a form of stealing. Many land owners have worked hard for years to create their little piece of paradise. Trespassers should get no leniency. I always like the idea of posting their face on a poster at all the near by public places that would most likely encounter them and people they know!
December 16, 2011 at 1:14 pm #116857There seems to be 2 classes of people in our area when it comes to hunting. The ones that somehow feel “entitled” to go where they want when they want just because they always have. Many in these groups have been prosecuted for trespass but they pay the fine and continue to take the chance hoping to not get caught again. I believe if a person is trespassing while hunting they should lose their hunting rights not just have to pay a ticket.
I personally had a much better year than last year with this problem but feel Joels and Bobs pain. In fact I am sure that guy walked all over through my dads property as well that day since ours borders Bobs.
This year I leased two of my favorite properties and posted them heavily and let the guys that I knew hunted bordering properties that I fully intended to prosecute them if I caught anyone trespassing. Of course because of this I am labeled an @#$hole by many of these guys but oh well!
I could go on and on with this topic. You guys don’t know the half of it and like Jason said I think this is largely a MN deal for some reason.

I had a problem on my adopted-parents’ land in WI. While on my night stand, I noticed a stand about 50 yards from me. I walked over and someone had put up a portable stand with a homemade metal ladder, not to mention cut down a bunch of small trees. We were flabbergasted! But then I realized that it’s right behind a wayside rest and they probably just parked (or were dropped off) there and did their thing. Well, jokes on them because we took the stand and soon the ladder.
I just wonder how many times we drove by and he was decked out in camo watching us.

I’m a strong believer that trespass penalties should be much more harsh. It seems that there are quite a few people still out there that have no repect for others property and I think the only way these types of people will learn there lesson is the hard way.
I’d like to see a mandatory 3 year revocation of hunting priveleges for first time offenders, a 5 year revocation of hunting priveleges for second time offenders and a lifetime revocation of hunting priveleges for a third offense.
December 16, 2011 at 2:25 pm #116863Unfortunately, people that would illegally enter another persons property like this are probably just like the scumbag poachers that sneak on and kill stuff at night or out of season. The laws & consequences don’t seem to deter them. These guys may not have hunting licenses to begin with. Kinda like the drunk drivers that have their driving privileges taken away, yet they continue driving, no license, no insurance. Frustrating!
December 16, 2011 at 2:44 pm #116864I know the feeling Bob. We encounter the same thing. Our property is completely surrounded by a fence, but yet they cut barbed wire and have the audacity to drive their ATV on our land. It’s going to be fun when I get a chance to confront them.

I have to agree with Justin. We have to make the penalties much steeper. The first offense is a $50.00 fine. Unfortunately there are many people that simply do not care and will gladly pay the $50.00 and move on. I have to agree with Kooty, these people are NOT sportsmen.
Penalties
• Violating the Minnesota Trespass Law can make you subject to
either civil or criminal penalties:
• Civil penalties are: 1) $50 for the first violation; 2) $200 for the
second
violation in a 3-year period; 3) $500 and loss of every
license and registration being used for a third or subsequent
violation
in a 3-year period; and 4) $50 for unauthorized removal
of a sign posted under this law.
• Criminal penalties are at least a misdemeanor for violation of this
law. In addition, it becomes a gross misdemeanor to: knowingly
disregard
signs prohibiting trespass, trespass after being told not
to do so, or to violate the trespass law twice within a three-year
period. Anyone convicted of a gross misdemeanor violation of the
trespass law while hunting, fishing, trapping, or snowmobiling will
have the applicable license and registration for that activity revoked

I’m not condoning trespassing, just an observation Sorry to hear about this Nothing burns me up than when someone else messes up your hunt and hard work

No more free passes! I tried calling them today but they wouldn’t answer the phone. I put a copy of the picture and a letter in the mail. I don’t trust myself in a confrontation at their home

I have trespasser stories galore, we literaly have 2+ face-face confrontations a year on our one property Most of our hunting trespassers have subsided after years of diligence, but the off season trespassing is obsurd. We have caught people at night, middle of the day, jogging, walking the dog, riding horses, 4-wheelers, snowmobiles, driving around in the fields, driving through fences, parking and drinking/drugs, driving mopeds and dirt bikes through my food plots, and even a parked car in the middle of the timber prokreating. Its absurd. We spent years sitting bumper to bumper every day with some slug hunters knowing as soon as we left they would walk into our stuff claiming ‘we wounded one and have the right.’ Last year I had 3 snowmobiles almost run me over in my ground blind as they were riding the drifts in my corn plot in the dead center of a 1 mile by 1 mile section!!!
I dont know if its a Minnesota thing or not, but I do know its an ignorant and selfish thing. These people literally feel they have the right to do as they please. Im not even sure if revocation of rights would stop some of these shmucks. Tresspassing was one of the driving factors in my brother and I getting our own piece of land on the river bottom. Im not an advocate of promoting physical confrontations, but I will say this; I bet alot of the people I have kicked out would have been back had I not been 6’6″ 260-290 through the years.
Like you, I live in a small community. I understand the implications of prosecuting all of these clowns in regards to various relationships. We have had some good luck with explaining our intent towards the land with some of the non hunting trespassers (those who are so out of the hunting realm they just didnt even comprehend what they were doing). But these shmucks wtih intent to hunt should be made precident upon your property. Sooner or later, their past and actions will catch up to them (we all know the kind of life style many of these people live).

My brother in-law and his friend where sitting in there stands on there land this year durning the middle of the week during gun season here and had 4 guys do a drive right past there stands. They got down and confronted them. They said they were lost and thought it was public land. Brother in-law points points out he sign not even 5 feet away. He was too easy on them though and just told them to leave. I told him he should have called the sheriff but he didn’t.
