I need an opinion from any experts on the MN Protection act/right to carry a handgun. Short of the matter is, I have had a permit to carry since the law was enacted in 2003, but just received a letter in the mail threatening to revoke it if I do not provide them with court documentation on some stupid mistakes I made as a juvenile. In short, they have found where I committed some offences as a juvenile (13 years old) but they cannot get any info on it because juvenile records are sealed. They want me to provide it or they “may” revoke my license. Is this legal? Do I have any recourse? I am 31 now and the worst thing on my record is a moving violation. I have no other offeses… not even a DWI. Nothing in my open record shows me as anything other than a really upstanding citizen. When the law was passed… they did a check for my permit to purchase… passed no problem. They did a quick FBI search at the store I bought my gun from… passed again.. and then after the law passed… I applied for the carry license… again, passed no problem. All of a sudden… 3 years later… they are giving me problems. Anyone have some insight or know a lawyer or expert I could talk to?

Interesting, I’ll do some digging. May take a few days.

Just one question and you can PM me with the answer if you like:

    Felony, Gross Misdemeanor, or Misdemeanor?

PM sent Jon. I don’t have much time, though… they want a response/information by Aug 4th.

Cletus, give Clay a call at Bill’s Gun shop and Range. I just spoke with him about this..

The bottome line is they can because when we sign up for a permit, we authorize enforcment agencys to complete a background at any time. In this case, there is “something” that indicates a conviction in your juvenile years…and they will be checking to ensure that these don’t disqualify your right to have a permit.

I’m not the expert…just relaying info…as Clay is busy at this time. Give him a ring if you have questions. 763-533-9594 press 1 then ask for Clay.

I’m sure he’ll come on-line and explain this better than I can relay it.
