Correct me if I’m wrong, but aren’t band members living on res. only subject to their own laws and law enforcement?

Sort of….. I live on the White Earth Reservation and tribal members subject to our counties law enforcement (primary for the county, tribal law enforcement is sub par) and the state patrol. There are exceptions: “regulatory” laws i.e. speeding, no insurance, running stop signs, etc. DUI’s and other more serious crimes fall under that juristiction of state laws. The only place this doesn’t hold true for in the the state of MN is the Red Lake Reservation which is termed a closed reservation. You need to be a federal law enforcement agent to arrest people on the Red Lake reservation.

Do you think local law enforcement is sometimes reluctant to investigate property crimes on the res.?

Thanks for the clarification TribePride. I believe what you say is true. However, in reality the county/state police seem to be in no hurry to enforce state law on the reservation. Especially at Mille Lacs. At least that is my perception.

Jon that may be true in the Mille Lacs area but here in Mahnomen county the whole county is with in the reservation. The tribe has to sign a “policing” agreement with the counties in order for their own police department to stop non-tribal members. The “reservation” communites in Mahnomen county tend to get more tribal police patrols so maybe thats why the county stays away from the reservation areas around Mille Lacs. In our county the Sheriffs department would have to investigate the problems that are seen at the launch but their might not be enough officers to patrol the area properly. We have a few launches in the county that I will not use for the same reasons and stated earlier.
