Copy right, TradeMark, or Registered???

    Need help ?? Is it necessary to trademark or copy right or register a slogan that I want to produce on clothing or hard goods that I don’t want people to steal. If so which one will cover you more than the other. Can you say something is copyrighted or does it have to be registered to be Copyrighted ?? Your help is much appreciated. Thank you

    What you’re most likely looking for is a copyright if it’s for a specific slogan or saying. But you could be looking for both, depending on what your trying to do.

    By “slogan” I’m assuming you mean something like:

    BrianK sez Fish Naked

    Or something (hopefully not too much) like that.

    A trademark is used to protect a brand name or trade property including the name, logo, and other associated properties.

    So you may need both if you’re intending to protect your company’s trade name (like BrianK’s Katfishing Kit) and let’s say your logo involves an open jar of stinkbait. That’d would need to be a registered trademark.

    No it is not necessary unless you plan on producing a ton of them and selling them to various places. If you are just making shirts for your business or a cool saying for you and some friends and maybe sell a few don’t even bother. If you are trying to make a new saying to go on t-shirts to sell in various stores, yes absolutely.

    Ever hear of “Twisted Fisher”?

    He pulls in several thousand dollars ever year going to Fishing Expo’s selling T-shirts, hats, can coolers & other paraphernalia with his slogan & an image of a fish that looks like a skeleton of a fish on them. (his logo)

    And Yes, he does have a copy right or something of that nature to protect his product & business interest.

    I say go for it! You may not make it big but you just might be able to pull in enough cash on the side to make it worth your while.
