If a person lives in MN and border jumps on a regular basis for work (90% WI, 10% MN) what state would they apply for Unemployment INS? The company is owned (Home Office) in WI.

I dont know if its the same between Mn and Wi as it is between Mn and Sd, but heres how we do it at my company. I live in Sd, my company is in Mn, I work in Sd and Mn but if I need to collect unemployment I collect from Mn because thats where the company is based and where they pay benefits. Hope this helps.

I think you have to draw from WI because the company is based out of WI and pays into their unemployment pool. Sucks MN pays alot more.

Since you are a Mn. resident I would call MnUI and try to make a claim. They might force you to Wi. but worth a shot. I travel all over(union ironworker)rarely working here and draw from Mn. The only kicker might be a Wi. based company but stand your ground

The bigger question is where was your employer paying unemployment into. If your UI was being paid to WI, then that is where you would draw, MN would be out of play Unless your employer was taking out taxes and paying into UI to MN when you were working there. Technically, your employer is supposed to pay taxes to the state you are physically working in, it’s a book keeping pain.

I live in wi, and work in mn and draw unemployment in mn, but u have a weird case there, but i would file in the state that you made the most money in. but not 100% sure

When you physically work in Wi then unemployment is paid to Wi. When you work in Mn unemployment is paid to Mn.
You can file either state. You only get credit for the work perform in the state you file for unemployment.

    Does that make any sense?

be very careful.. this last time, I filed under Minnesota. when it came to extended benefits, I missed by, are you ready for this? $50 bucks.. total. and Minnesota refused to budge. so now I am working for what I used to get in UC claims.. and another friend missed extended benefits by$15 bucks.. an hours worth of work.. and Minnesota didn’t care or give a rip.. and I could have used the Wisconsin system.. so be very very careful.
