I assume that since they used the term “carjacked”, there was some form of threat to the victim.
December 14, 2012 at 6:57 pm #1120475I’m just reminding everyone who carries, you still have duty to retreat. Those of us who carry should be treated the same as off duty cops. We both are required to abide by the same laws. If I shoot a car jacker with no duty of retreat, I go to jail.
I’ll give you this. The story did not mention if the cop was arrested. I assumed not.

December 14, 2012 at 7:49 pm #1120481The guy isn’t going to come and say please, it will be with a threat of bodily harm, and in my opinion, a robber like this now days, you can’t assume they will just leave you unharmed if you fully comply. If you can protect yourself with deadly force, I can’t see why it wouldn’t be fully justified. While turning and running may be the right move in the mind of some – I personally wouldn’t want to get shot in the back either. My home address and such is in that vehicle…. and home keys on my keychain…. no I’m not going to be just ok handing it over and hoping for the best if a better option exist.

Ya, maybe in your neighborhood they just rob ya, in mine they probably will add a little physical pain to the mix.
I did find this,
A duty to retreat does not attach to defense of dwelling claims. So long as a person claiming
defense of dwelling meets all of the criteria for making his or her claim – that the killing was
done in the belief that it was necessary to prevent the commission of a felony in the dwelling,
that the person’s judgment as to the gravity of the situation was reasonable under the circumstances,That’s part of it, also found that at least 4 times that hasn’t worked here and the person evidently should have retreated.

I will take my chances in the court of public opinion.
But then again – who would want a minivan with my kids in it….

It would be if he attempted to run me over! And I GUARANTEE you anyone jacking my car was trying to run me over.

Last Thursday night around midnight, a woman from Houston , Texas was…arrested, jailed, and charged with manslaughter for shooting a man 6 times in the back as he was running away with her purse.
The following Monday morning, the woman was called in front of the Arraignment Judge, sworn-in, and asked to explain her actions.
The woman replied, “I was standing at the corner bus stop for about 15 minutes, waiting for the bus to take me home after work. I am a waitress at a local cafe.
I was there alone, so I had my right hand on my pistol in my purse hanging on my left shoulder. All of a sudden I was spun around hard to my left. As I caught my balance, I saw a man running away with my purse. I looked down at my right hand and saw that my fingers were wrapped tightly around my pistol.
The next thing I remember is saying out loud, “No Way Punk! You’re not stealing my pay check and tips.” I raised my right hand, pointed my pistol at the man running away from me with my purse, and started squeezing the trigger of my pistol.
When asked by the arraignment judge, “Why did you shoot the man 6 times?
The woman replied under oath, “Because, when I pulled the trigger the 7th time, it only went click.”
The woman was acquitted of all charges. She was back at work the next day!
