Roadside Boat Checkpoints Starting This Week-MN

    Make sure your legal and sober if you plan on towing a boat anyplace.

    Conservation officers will conduct Minnesota’s first random roadside checks of boaters ever this week, part of a crackdown to slow the spread of invasive species.
    The checks were to begin last month, but were delayed because two county attorneys expressed concerns over the legality of the stops.
    It’s unclear if those concerns have been resolved, but the Department of Natural Resources will begin the roadside checks, where county attorneys will prosecute invasive species violations, said Jim Konrad, DNR enforcement chief.
    Two check stations will be conducted this week at undisclosed locations — the first of at least 36 random roadside checks that will be done this season, said Konrad.
    “Everyone understands the importance of keeping the spread of invasives from getting worse than it already is,” said Konrad. “We will try to make this as painless as possible.”
    Konrad sent notices to the state’s county attorneys last week explaining why he believes a 2011 state law gives conservation officers authority to do the random checks, and why the checks differ from random DWI roadside checks previously done by the State Patrol.
    The state Supreme Court ruled in 1994 that those DWI stops were unconstitutional, and they were discontinued. The DNR contends that ruling didn’t preclude all check stations.
    “This is more focused and less intrusive,” Konrad said. Only motorists pulling boats or water-related equipment will be stopped, and only “in proximity” to boat landings. Also, the state law made compliance with the inspections an “express condition” of operating or transporting boats.
    Neither boaters nor media will be told ahead of time where the stops will be conducted, Konrad said.
    “If we telegraph our locations, people might avoid them,” he said. And he said he doesn’t want the check stations to become “media circuses” either.
    Under the plan, motorists towing boats will be directed to pull into an inspection area staffed by conservation officers, boat inspectors and boat decontamination workers. Violators may be cited. Boats with invasive species attached will go through a high-pressure power wash.
    Konrad wouldn’t name the two county attorneys who have raised concerns. “We’re trying to cooperate with them,” he said.
    He doesn’t believe the stops infringe on boaters’ constitutional rights.
    “There’s a level of intrusion in almost every part of our life. This will help us protect our waters.”
    But Konrad said he wouldn’t be surprised if someone challenges the roadside boat checks.

    Who are these people? You’re right Bret. The way this country is evolving scares the **** out of me.

    The rights and freedoms I am accustomed to, guaranteed to me and signed in blood by others for me, FAR outway some new clams in a lake.

    So long story short, I’m supposed to keep my out of MN? Done

    This is getting out of hand…have they ever thought of other things that could transport AIS? Like anchor ropes, marker buoys, fish baskets, and the like? Nope. I would be willing to bet that is the cause of some of the spread. Not checked either. Along with water inside the trolling motor….

    Yes, I will be very interested in how this is rationalized.

    Especially considering roadside DWI stop-em-all checkpoints have been specifically declared illegal and unconstitutional already in this state.

    My guess is the DNR is counting on thier generally unchallenged practice of conducting searches that for regular law enforcement would require a warrant.

    Won’t be any “cleanzing” going on. Only the docture of the DNR will be permitted.

    For those sucked into the inspection I’m sure you will come out much smarter for the expierence.

    This is not even a public safety issue.
    Just the DNR thinking they are above the constitution again!

    I’ll give the DNR a pat on the back for trying to do something. However……………

    doesn’t this seem like trying to stop the flow of the Mississippi with a fly swatter?

    I’m going to ask the question again.

    Since a regular LE can’t stop a car without having a reason to check his D/L, how can a CO stop us to check our fishing license just because we are fishing?

    Both are privileges.

    If the fishing license check would hold true for driving, an LE should be able to stop and check our D/L just because we are driving.

    Following though with this thought, our cars, boats and homes should be checked for AIS if there’s a boat in our yard. We might have brought in some zebs from infested waters in a bait bucket.

    I know it’s already against the law to transport AIS, but if that’s the case…why the check points?

    Any predictions on where these will be set up. My guess would be near Minnetonka and Mille Lacs.

    They won’t be doing road side checks to see if you have a fishing license. It is being done to reinforce the existing laws. I’m hearing that 4 out of 5 boaters aren’t doing boat inspections prior to leaving a ramp. It differs from the old DWI road checks, since most cars aren’t pulling a giant 5th of booze down the road. In this situation there is at least some indication that a boat is attached (LOL). Does this automatically mean your a law breaker? Heck no! But being checked shouldn’t be a problem for someone who has hand-picked vegetation, drained bilges, livewells and buckets.

    Curious? How would you enforce the laws? Have anyone with a bale of weeds on their trailer drive to a DNR office and confess their wrongdoing? I can see the line of trucks doing this now(not).

    Doesn’t that statement just contradict the rest of his justification of the Checkpoints?

    i.e. If that statement was true, then there shouldn’t be any NEED for the checkpoints; should there?

    Brian I would go the other way. Instead of remaining silent I would make it my goal to tie that inspection point up for a hour if possible. I would ask for an explanation on every compartment they wanted to look into. What they were looking for, what it looked like, how big was it, where could it have come from, how many people get it, ect. , ect.
    Then I would launch into a thank you speech telling them what a fine job they are doing protecting us from the evil AIS. I would ask for identification so I could mail a thank you card and let their supervisors know what a fine job they are doing.

    Remember, not even the prosecutors believe this is legal. They know they will get beat like a rented mule when this gets to court.

    Instead of making this painful, make it a fun experience for yourself and as painful as legally possible for the inspection teams. But PLEASE……be courteous, these will be $7.00 an hour college kids, the brass will be at home drinking a cold beer.

    Like if my drain plug is in. Doesn’t matter whether there’s AIS in the hull…that law?

    Buzz? You weren’t on the committee that recommended that drain plug law were you? Please please say no!

    Dutch, I would be surprised if the checks would be college students. Road side checks are normally to risky to allow them to do this.

    But you’re right. Keep it positive.
