restricted access to pool 2 backwater

    has anyone been told that they cannot fish on the river in marinas or private land suronnding the river? i have been told i cannot fish on private property IE: inside the harbor
    whats the rule?

    Ive never heard of this and i live on pool 2. I know some barge areas that dont want any fisherman nearby but dont know that its illegal,

    If you can access the area by water they can not stop you. If they hassle you call the DNR or Sheriffs office. Had a marina owner here in Hastings attempting the same thing. The other side of the rule is if the water goes up the LAND owner looses property line. If it goes down he generally gains. Where is this taking place?

    The response I got from a DNR rep about this was yes you can fish in a marina, no they can’t stop you, but do you really want to deal with someone like that in that situation.

    You can call the sheriff and the DNR. Its better to have them explain the laws to them, even though I am sure they are aware of it.

    Here is what I would do. If you are being constantly harassed to where it interferes with your enjoyment or even becomes a safety issue, but you really want to fish in there, back out of the marina, make the call and wait.

    If the person was passive about it, I’d tell him the law says I can and I welcome him to call the sheriff/DNR. If someone was irate and aggressive, I would take the former approach.

    I agree it needs to be instilled in these idiots that they don’t own the water in the marina. If enough people keep confronting them, maybe they will give up. Some of the jerks need to be told.

    Also it is better when dealing with someone who is not threatening or more passive to have them make the call. These are the sort of issues where if someone has to come out like the DNR or Sheriff where the guy calling is wrong, the DNR/Sheriff will not be happy with them.

    Lastly, it might not be someone who works in the marina doing this. I bet a lot of times it is the slip owners.

    Watergate Marina has a no fishing inside marina sign as you go in. I guess it is not illegal to post a sign like that, even if it is invalid. They are hoping to convince those who don’t know.

    The no wake zone in front of Treasure Island is not recognized by the CG, Sheriff or DNR.

    It would be the same as if Everts put out no wake signs. Unenforceable.

    After saying that, when I go by the marina, I do drop down to no wake speed. That’s just common sense, but I don’t run the whole 1/2 mile at no wake.

    Water gate is the only marina that I have heard of tying to keep people out of it. There is a barge channel on the lower end of the pool that is off limits to. Think they are loading fuel there or something just like the area in front of the St Paul Park refinery. Dont think I would want to mess with the refinery folks.

    As far as fishing on posted private property yes its against the law. No different than trespassing laws anyplace else. Lots of private property on pool 2.

    I dimly seem to remember a few years back that a marina owner (Redwing??) tried to stop the bass tourney guys from fishing “his” marina. He got a ticket and lost his argument in court- – jerr

    Is there any more info on this? So there are non legal no wake bouy’s? how would one know which ones are real and which ones are “fake”

    It’s worth noting that is actually a crime to harass or interfear with anyone who is legally engaged in hunting or fishing activities in Minnesota.

    I agree that many water-side property owners are getting too big for their britches in Minnesota and they need to be taken down a notch. If encountering harassers, tell the person once that it’s a crime. Then call the sheriff’s department and report them, specifically stating that angler harassment is a crime.

    Nick, if you locate any CG, DNR, Boating map that shows no wake zones, you’ll know where the legal ones are. Like the no wake zones on the St Croix after the No Wake buoys are pulled, it’s still a No Wake Zone and can be legally enforced if the LE choses to cite a person.
