Permit holder involved in fatal shooting

    When coming back from, VerHalla, my summer Northern MN retreat this past Spring, my wife and I needed to make a pit stop. We found a DNR facility with a small parking area that was deserted, so we decided to stop. She used the facility while I waited in the car. Upon her return, it was my turn. As I returned and got back into the drivers seat a, car suddenly pulled into the lot and looped around coming to a stop with the passengers front side of their vehicle pinning my Jeep against the curb. I looked out the wife’s window, I found myself staring in the cold, steely eyes of the front seat passenger of the blocking car. This guy that obviously sizing us up. As my wife and I were both packing heat, I told her to pick up my 38 special, which was holstered and tucked between the bucket seats. I further told her to pick it up by the handle making sure our nefarious observer saw the weapon while handing it to me. I must confess to briefly considering putting the laser dot on the Dud’s forehead, but decided against it. Almost immediately after seeing the weapon the car pinning us backed up giving us enough room to back out and exit the parking lot. As I drove away, I saw a third person come out from behind the toilet. My parting words to my wife were “This is exactly why we have concealed carry permits.” I was vastly relieved this incident had not escalated into something more sinister. I was even more relived that we were prepared had the situation taken a more deadly course.
    I am happy that both of us have a Minnesota concealed carry permit. I am currently preparing to obtain the soon to be enacted (11,1,2011) Wisconsin concealed carry License. Out of my cold, dead hands!

    I if I were to guess I’d say at this point it’s 80-20 against the Grand Jury indicting.

    Now the civil part is pretty concerning the sister is on record as saying “you can’t just shoot a robber”

    I wonder what the odds of are of having someone represent this guy Pro-Pro-bono on the civil end if that happens, which, win or lose could add up to a hefty sum.

    You can’t just shoot a robber, but pistol whipping, robbing and then shooting at someone following you is OK.

    She needs to shut her pie hole.

    Well Well Well… looks like the “witness” won’t be as credible as some may think. The person WITH the criminal was his sister. Turns out… she was an accomplice and wtih him when he commited the crime… She was with him when he got what he deserved.

    Tuesday police arrested the sister of a robber who was shot and killed by a witness last week.

    Officers believe Octavia Marberry was with her brother, Darren Evanovich at the time of the robbery at Cub Foods on 26th Avenue South last Thursday.

    The shooter told police he shot Evanovich after confronting him for stealing a woman’s purse. The witness had a conceal and carry permit.

    Marberry called 911 shortly after that shooting. She’s facing aiding and abetting charges.

    The gunman who shot and killed armed robber Darren Evanovich last week in a Cub Foods parking lot will not face criminal charges, after prosecutors determined he acted in self defense after Evanovich pointed a handgun at him and told him to mind his own business.

    Hennepin County Attorney Mike Freeman determined that the witness, who was not identified, had tried to get a woman’s purse back, but was justified in his actions on the evening of Oct. 20.

    “While this man is to be commended for helping his fellow citizen in need, a note of caution is appropriate,” Freeman said. “We prefer that armed citizens do not chase after criminals. Too much can go wrong, with deadly consequences. It is our preference to have our highly-trained and armed police force respond in these kind of cases.”

    Freeman also announced criminal charges filed against Evanovich’s sister. According to the complaint, Evanovich along with his sister, Octavia Shonte Marberry, 20, of the 400 block of Newton Av. N., Minneapolis, and a third unknown male robbed a 53-year-old woman outside the Cub Foods at 2850 26th Av. S. The three then ran away, but not before a witness saw them and followed in his car. The witness, who was not named in the complaint, caught up to Evanovich and asked for the woman’s purse as Evanovich rifled through it. Evanovich pointed a gun at the man and told him to mind his own business. Fearing he was about to be shot, the witness fired his own gun at Evanovich, killing him.

    The complaint alleges that Marberry robbed at least two other women on earlier dates, pulling a knife on a 59-year-old woman Oct. 12 near the Target store at 2500 E. Lake St. She threatened the woman and took the woman’s wallet while an unknown man working with Marberry took the woman’s car keys.

    Three days later, a woman brandishing a knife and two men robbed a 56-year-old woman in the Cub Foods parking lot. Marberry later used the woman’s credit card. The woman also identified Marberry as her attacker.

    Marberry has been charged with two counts of aggravated first degree robbery.

    I was happy to hear the county isn’t filing charges. Is he now going to face a civil suit brought by the scum bag’s family? I would hope not, but I would be surprised if they don’t.

    I like this guy I wonder how many times a thug would get shot & killed, before it started making some of the others think twice… I like his idea

    Read a reply on a news website that said it that person was on the jury of a civil trial they would award the family $.02. And then send them bill for the bullets used.
