We thank all of you for the overwhelming support we have received about Canadian charts over the past months. However, our best efforts to obtain a fair agreement with CHS and NDI have been unsuccessful. We have offered to accept the fees demanded by NDI on a temporary basis, and we have offered to accept binding arbitration to reach a long term agreement. Both of these offers were refused.
It is clear that action must occur to ensure the safety of boating and stop irreparable damage to Canadian businesses. Many Canadians have urged the government to intervene in this issue and the Department of Fisheries and Oceans is now considering some changes as a matter of urgency.
Safety
We can no longer ignore the risks to lives, property and the marine environment by not providing our updated electronic charts compatible with navigators’ plotters.
Business
In addition to the impact on safety, Canadian marine businesses and tourism are suffering millions of dollars of lost business because our electronic charts are not available to the people dependant on these in their marine activities.
Conclusion
Therefore, we feel responsible to resume shipments of Canadian charts to those navigators that request them. We will continue the vigorous campaign for fair terms, open competition and the best value in electronic charts for Canadians. We will accrue and escrow royalties for sales of Canadian chart data, at the international rate, and we will deposit this money in a Canadian bank account, administered by our lawyers. These funds will be paid to CHS or DFO when an agreement is reached. If a “no-royalty” solution similar to the USA and New Zealand is their decision, we will donate these funds to a Canadian marine-related charity, or a non-profit such as the Coast Guard Auxiliary.
