Thanks for the report Ron. I was wondering if anything was going on up there.

    Stay safe!

Ron, we can go this weekend and I’ll pick up suckers from a trusted source…Bob Moore. They keep much longer than your average sucker. I think it’s because he talks to them during the day and tells them a bedtime story before he leaves.

I feel like running down some tripped tip ups and jigging up some panfish. Oh yeah, and BEER.

Hmm, relooked at the DNR info on Centerville and there are eater bullheads in there! I’d get my flathead bait there too of they weren’t over the regulation.
Man, if it weren’t so far, that’s be a great place to harvest them. I know exactly where you could easily on Peltier too. Oh yeah, it’s only January 1.

Went out yesterday afternoon and discovered my fish house was broken into. -( -o This is what I had in there.
    4 camo highback chairs.
    1 wood tip-up
1 old spinning rod and reel.
    shovel
    1 fish scale
    1 pair ice cleats
    1 ice scoop

What is weird. Nothing was taken but the old rod and reel combo. Did these robbers have a conscience? I’m glad they didn’t take the chairs. I really like them. -D I guess I have to move the house back near the crowd so their is a little more protection. It has never happened to me before on Centerville.
The fishing didn’t pick up until near sundown and after dark. Crappie and sunfish. Mainly small with a few good ones. We also had a sucker minnow down and a fathead minnow on another. So what does the northern bite? My powerbait grub on a shrimpo…. That was fun. It was a good time in there. We had 5 of us having a few barley pops, catchin fish, fishing in our t-shirts staying warm during a deep freeze! You got to love Minnesota fishermen/women.
As soon as it warms a little I am moving it to another spot I marked in the summer closer to the others.

Oh, I thought that was my rod and reels combo.

Robbers with a conscience? That is a major contradiction. That sucks, but I guess it could have been worse.

I have a piece of property that I have exclusive permission to hunt on from the owner who lives out of state. She leases out the land to a farmer his lease says nothing about giving others permission to hunt the land but he does anyway. The owner has also given me permission to run off trespassers but it is only a verbal agreement same with the exclusive hunting privileges. The sheriff tells me to cover my butt I should have something in writing from her, here is my question does anyone have a situation similar to this and have something in writing. The land owner would have no problem putting something in writing for me but I would like to make it easy for her and just send her something that she could sign and send back to me. Anyone have any ideas?

We found ourselves in a very similar situation a few years ago. An 80 that my brother in law rented suddenly found some additional hunters 2-3 days before the rifle opener. My BIL saw the folks parked in the small landing area unhooking a camper. He stopped to ask what they were doing and found the actual owner had given his buddies permission to hunt the same land! My brother in law said no dice, the land is leased out. The buddies got angry at first until BIL produced a copy of the written lease (At his office in nearby town-He’s a Realtor). After a quick check with a local attorney, just to be sure, my BIL was assured that his written contract trumps a verbal agreement. If push came to shove, which it didn’t, Wisconsin’s law would provide for the written contract while admonishing the verbal agreement. Once leased the landowner gives up certain rights and releasing the same property for the same reason and same period of time is one of them unless otherwise stated in the original lease.

As it turned out the buddies, who drove from the southern side of Chicago to central Wisconsin, got help from my BIL and found a 50 acre parcel a 1/2 mile from the 80 they were going to hunt. It cost them $100 for the entire season and they were able to use the landowners small mobile home and not have to use their tiny camper!

Moral of the story: Work together and all will be well. Good luck!

Steve, write something up, stating the acreage that you have “exclusive” rights to hunt the property. Have it state that it is rented for “agricultural purposes” only to the other named individual, with no rights to hunt or grant others permission to hunt. To take it a step further, I believe if you pay her $1, you can post it in your name with a written lease. Good luck.

What does her lease to the farmer say? My thought would be that unless the lease to the farmer doesn’t specifically state that the lease is for the crops only then the owner doesn’t have a whole lot of say who can access the land. It would really be up to the leasee. He is leasing the land and I would assume that means all rights associated with it unless specified otherwise. If they have a written agreement I would try to get some wording into it stating what their lease covers. If it is verbal I would push for them to get something documented.

Steve, I would take it a step farther as this is very similar to the situation I am facing down by Mankato. I would ask her if it would be ok to “Post” the property and have your name on the signs. Basically you would be acting as the property manager. This will give you more authority when tresspassers do show up. This would allow you to call the Sherriff and prosecute if you wish. You would also need the written letter stating such.

    Googled this one up:

    Sportsman’s Lease
___________________, referred to as SPORTSMAN, and ____________________, referred to as OWNER, agree:

in consideration of the payment of $____. __, SPORTSMAN is granted a non-exclusive license for the following hunting:

    ___________________________________________________

    During the following dates:
    Beginning date: _________________________________
    Concluding date: ________________________________

Provided however, that if the legal season for such hunting is less than the time specified, the license shall terminate at the same time that such hunting season concludes.

The premises licensed herein consist of:
    ___________________________________________________________
located in the County of ________, State of________

SPORTSMAN agrees that that he will conduct all hunting in strict accordance with the relevant regulations of the laws of the State of ______, and further that SPORTSMAN will indemnify and hold harmless OWNER harmless from any and all activities and the results thereof in violation of such laws and regulations.

In the event that the activities of SPORTSMAN result in damage to property or personal injury, SPORTSMAN shall indemnify and hold OWNER harmless from any claims resulting there from.

SPORTSMAN shall provide at his own expense all necessary permits for the same. In the event that the hunting contemplated cannot take place due to regulatory changes, HUNTER may select another lawful type of hunting in place of the designated game. In the event that no hunting is practicable or possible, SPORTSMAN shall not be entitled to a refund of any license fee paid.

Should the context so require “hunting” shall be inclusive of fishing, trapping and target shooting.

Do you know this for a fact, and have read it yourself???

I have asked the same question from a few farmers and landowners I know. Unless the lease SPECIFICALLY states that the lease is for farming purposes only, the Leaser has ALL rights to the land for the allotted time period. They are leasing the land and all associated rights on that land.

Think of it in regards to a house. I lease a house from you. I have all rights to that house except what is specifically noted.

I don’t think it would come to this, but my understanding of the situation is you could be SOL.
