Guys I need some help here I have a peace of property that I have been bow hunting for 5 years, I have a verbal agreement with the land owner for exclusive hunting privileges. The land owner lives in Florida and leases the land out to a farmer. The problem I am running into is there are other people hunting the land that think they have permission to hunt there. One guy says he has a hunting lease with the leaser, our local Game warden tells me that he is in the wrong he needs to go thru the owner for such a lease. Another guy has permission from an adjoining property but he is actually going beyond the property line and hunting on the land that I have permission to hunt. I am sure the land owner will be willing to have some kind of written agreement ( a lease for hunting rights) with myself. I want to make it easy for him and have something already written that I can send to him. Anyone know where I can find a standard hunting lease to send the land owner? The other question I have with a hunting lease in hand do I as the leaser have the right to kick off trespassers or does this have to come from the land owner. The sheriff told me that just having exclusive permission to hunt the land does not give me the right to run off trespassers, I did not think to ask him at the time if this would change if I had a lease.

I would be very carefull and let the law enforcement handle it. You don’t want them shooting at you if you know what I mean. One bunch of hunters killed is more than enough.

In Wisconsin the DNR does not enforce trespass and the Barron County Sheriff’s department will only enforce trespass when contacted by the landowner. Never a more gray area in my opinion. I stopped leasing land for that reason in itself.

September 25, 2005 at 5:03 pm #10023I would have to say if you show a person the lease they would respect it if they have any ethics at all. It seems odd that a guy that does not even own land is leasing it to another individual, did you bring that to the actual landowners attention?

I can not call law enforcement if someone is trespassing it would have to be the land owner, he lives in Florida I do not want to bother him with this because he will not want to be bothered with it. My question is if I have a lease for hunting rights will I be able to call law enforcement if someone is trespassing on the land?

September 26, 2005 at 1:30 pm #10042You can pretty much write anything you want into a lease weather it is leagal or will hold up in court that is another question, looking for feedback from others that have a lease.

September 26, 2005 at 7:38 pm #10054Maybe talk to the farmer who leases and explain situation. I’m guessing that if you bother the owner with this too much he will figure it’s more trouble than it’s worth. Sorry you have to deal with it.

I usually wait to talk with others at their vehicle after dark or late morning to simply let them know where I’m at and then be sure they know who’s land they are hunting.
I think having a signed agreement might be helpful in that you could show other hunters you have signed, written permission from the land owner. If you show it to them, the might just leave on their own knowing they don’t have anything similar.
I’m not sure where your at exactly in SE MN, but I know the warden quite well in Wabasha. He’d likely be willing to answer your questions over the phone – or he simply may patrol the area and check a few hunters a little more often.
