Im not sure if every one has heard of lake edith? but its location is in afton, and I have been wondering where indian trail buts up to the lake if you can legally walk on and access the lake. there are private porperty signs right by where the lake damn near touches the road. I know for fact that the people that live around the lake do not want people out on the lake, and it seems like they are all apart of an anti fishing cult.

lake access question?

I called the DNR about Edith years ago.
I asked “how can they do this? Isn’t there some public land between the lake and the road?”
The answer is “NO”.
I don’t recall the exact reason, or how it’s written, but that area is private property up to and may include part of the road.
There’s only small fish in there anyway.
December 21, 2011 at 1:49 pm #1019875I fished it twice in a boat with a friend who knew someone, we pounded large mouth all day. How can they own part of the road? doesnt the state own 60ft both sides of the center line, and i know for a fact that the lake comes with in like 25, I was thinking on getting dropped off and walking out, but i know the cops would end up coming, and i dont really want any trouble. just want to fish.
real small
December 21, 2011 at 2:00 pm #1019877YOu have to check County plat books. Some roads do not have public right of ways.

December 21, 2011 at 2:17 pm #1019887If the lake floods or rises a few feet, and you have property right up to the shoreline, do you loose property cause the water rising or do you now own a lil part of the lake? Thanks in advance

Looks like you can’t fish the lake and Edith too.
That’s funny Dan!
When I called it was a high water year. If I would have been dropped off with my belly boat (yes it’s a big one) I could have taken one step off the road and been in the water. There isn’t any publicly owned property on that side of the road.
By any chance you didn’t enter on “granny’s” land did you?

If it’s a public road that anyone can drive on, how could those types of roads not have a public right-of-way?

December 21, 2011 at 10:27 pm #1020127I’ve never heard of this before I checked into it back in the late ’90’s but from what I recall it’s private land that was was allowed to have a public road built over it making the shoulder to the lake private property.

An update was provided on the Lake Edith Indian Trail Access. This is a request that has been made to establish a Public Access to Lake Edith. The Parks Committee is evaluating the request.
December 22, 2011 at 2:33 am #1020220There are always a road right of way a little thing I learned when surveying!! but without looking at it I couldn’t tell? I’d take the chance with the police if it looked right!!! Where is this located? I’ll go I love to prove people wrong!!!
JasonDecember 22, 2011 at 3:43 pm #1020373talked to the police about it, and there is no right of way because the city of afton owns the road not the state. and apparently it is catch and release, i did not know that myself. The only way to get on is either knowing some one or walking up the creek to get on.
December 22, 2011 at 4:08 pm #1020384From the City of Afton….
Good Morning, Brian;
Thank you for contacting the City of Afton with these concerns. I hope the information below answers the questions posted on the forum. Feel free to post this information to the forum as it is public data.
The City of Afton has not stated that Lake Edith is a private lake. We have declared that Indian Trail as it abuts Lake Edith is not a public access to the Lake. Please see the attached Resolution which the City Council adopted on June 21, 2011, which states the reasoning for declaring it as a No Public Access point and authorized the posting of
the signs.Sara Irvine, MCMC
Unfortunately I can’t post the PDF file.
December 22, 2011 at 10:37 pm #1020559Further clarification from Afton’s City Attorney.
To clarify, Sara, this is one of many circumstances in this state where there is no access to a public lake. The waters are public. There is no right of trespass to access them.

December 24, 2011 at 3:00 am #1021026We flew in to edith, yep landed a plan on edith in the late 80s. Fired up the auger, before we got the holes cut here comes the land onwers. Talk about a bunch of un happy campers, said we would be arested, washington co. said they could’nt do that. talk about a bunch of people bent out of shape, the guy that flew the plane looked at them and said he saw friendly er people in viet nam.
December 24, 2011 at 3:07 am #1021029This will get back to the people that live on the lake, they will have armed guards on indian trail. Drop your auger put your hands in the air. You even drive slow by their and there all over ya.
