    Status of Allowing Larger Bullheads as Bait

    Brian-thanks for making the time to personally touch base last week, as well as for your letter regarding the status of changing the rules so that larger bullheads can be used as bait. We appreciate your group’s willingness to work with us on this rule and for your patience through what has turned out to be a long process. You mentioned that some members of your group are concerned that the DNR will not follow through with promulgating this rule. I want to assure you and your members that we have every intention of completing the rule and would expect to have it in place for next year.

    As you indicated in your letter, we had hoped to have the rule completed within a two-year time frame, but there were several issues that came up that have delayed implementation. With all the other issues facing state government, it took additional time to gain approval to proceed from within our agency and from the Governor’s office.

    We then determined that there were some changes to state statute that needed to be made. We initiated discussion on those changes as we started the 2006 legislative session with a request to change the minnow definition to include larger bullheads. As we worked through the process, it was determined that changing this definition would complicate too many commercial minnow issues. We did determine that bullheads of the non-minnow size would be classified as rough fish and not game fish, so we felt the prohibition on bait listed in 97C.341 was not applicable. We still needed to ensure that the transportation law (97C.205) would allow the live transportation of the larger bullheads, since they were not being classified as minnows. We did this by clarifying that the commissioner had rule making authority to allow and regulate the transportation of live fish from the water body in which the bullheads were harvested. We appreciate your assistance in having these changes approved.

    The rule in which the bullhead changes are incorporated also include proposed changes to tournament rules. Working through some of these issues has taken some additional time.

    We are currently finalizing the “Statement of Need and Reasonableness,” and, as referenced earlier, would intend to have the rules in place next season. As we discussed last week, I understand your frustrations with the length of the process and appreciate your continuing to work with us.

    Uff Da! Who would have thought wanting a longer bullhead would have SOOO many implications. No wonder it takes so long!

    Big tip of the hat to you guys and the DNR for diligently working on this. BIG tip of the hat! Shoot, I’ll buy drinks for both BK & Dirk when this becomes law, ummm… or rule… or regulation… or whatever it is!

    My come back was going to be, we get to use 8″ bullheads next year. I guess I should not make fun as they are following through.

    I really wasn’t looking for a congrates thread… after all, nothing has really changed at this point.

    The wording that hopefully will be passed will allow anglers in the lower portion of the state to transport 100 (your limit)7 to 10 inch bullheads.

    244 Seven inch and under bullheads (minnows)

    100 Seven to ten inch bullheads per licensed angler.

    It’s going to be sweet going to Moore’s Bait and Tackle and able to buy 8 to 9 inch bullheads…even if I have to pay a little more for them…..someday.

    I’m a little surprised that the muskie guys didn’t get behind this.

    Too bad, congrats anyway. Deal with it.

    100 10″ and under. That is sweet. If I get any bigger than that I can eat them.

    Have musky guys had success with them? I talked to Bob about it and I know they were experimenting with them, but I did not know if they were successful. If I were a musky guy, I would hook them through the lip with a float big enough to keep them on the surface and then reel them in slow letting the tail splash around.

    I have used little bullheads for bass, but really, can you call it bass fishing if you aren’t using artificials?

    It’s a wonder anything gets done in this state. Talk about complicating something so simple. Gotta love our government.

    Don’t feel bad about your government taking so long!!! It takes all government a long time… Heck when I was working in the private club business, it took them a long time!!! Anytime there are more than three people, heck maybe even two people, it can take a long time.

    BK and the rest, great work, the patience to see that whole thing through is a great thing to have in those types of process…

    Everyday in Illinois…but the rules about catching and transporting bait are another story…

    Now just wait, the day they change the bullhead rule they will also changes laws to deal with the VHS issues like they have IL and WI and you won’t be able to use bullheads at all!

    Unless you catch them and use them on the same water without ever leaving your boat.
