Background Check Delay

    So I went in to Sportsman Warehouse to purchase that Sig P365 XL Tac Pac deal they had going on Saturday since I did not spend my money on Livescope. I have my conceal permit already, ran through the questions and waited a while. The guy helping me said my back ground check came back delayed and he would hold the gun and call me. Anyone else ran into this and if so how long did it take to hear. My plan is to call today.

    Every time I bought from gander they would have a delay. Fleet farm has never been longer then 45 minutes. I bought 2 guns at ff over the weekend with 0 delays. The delay shouldn’t be longer then 48 hours tops. In my experience it comes down to the businesses computer more so then the check itself

    They can transfer it without a response on Thursday if it was submitted on Saturday. Might get an approval before then but that’s the longest it can be.

    Are you former mil? Sometimes if there was a prior security clearance associated with your name, NICS will “flag” it as something for them to look at more. Just the way the system works unfortunately. Either way, the most that they can delay your purchase is 7 days, at which time as long as they haven’t come back with a “denied” that “delay” tolls to a “pass” at the 7 day mark.

    There is a chance that has changed as the last time I worked in firearm retail was 10 years ago.

    A common name can get you delayed too. Or at least use to cause it. Worked for gander in college. Our gun department managers name was Scott Smith. Said he got delayed every time.

    Fleet Farm does not have the Tac Pac which kinda makes the deal with 3 mags and a holster for $519.00 there was at least 3 being sold while I was there.

    The common name thing may be playing a factor, when checked by a CO on red I was informed when he checked my license he said there was another guy popping up with the same name and it was confusing him.

    Yeah I was telling myself why do you need another carry size 9mm, but I can’t pass up the deal. Can’t wait to put some rounds down range.

    I don’t and haven’t bought a gun in years, but I thought the purpose of getting the permit to purchase and/or having the conceal carry was to avoid waiting periods. doah

    When I’ve gone to the buck banquets I’ve got the permit to purchase documents on the very rate event I would happen to win a gun.. never have though.

    Carry permit counts as a permit to purchase. A permit to purchase is only good for 1 year so a carry permit being good for 5 is more convenient. Doesn’t change anything about the NICS check an FFL has to do though.

    Glenn I thought that also that is what kind of caught me off guard. I knew they had to run a quick background check to see if something changed, just did not expect to be delayed to the point I would not walk out with it.

    My last several have been online and though a local FFL. Their calls have always take a couple minutes while I sit there.

    I just called them to see if there was an update and they must be getting lots of calls, he did not even look, he just said they will call when they find out and said it is usually 3-5 days. smash

    Random question:

    Is the same background check and delay required for hunting rifle purchases even when I have the permit to purchase card? I cannot remember the last time I purchased a long rifle in a store or from a business. When I purchased a .357 in a business a couple years ago I had a 1 day delay. I try to buy everything privately that I can for simplicity, but there are a couple items on my shopping list that may require a run to Scheels in the near future.

    Yes, this is NICS. Has nothing to do with permit to purchase which wouldn’t even be needed for a hunting rifle, unless it has a pistol grip.

    My dad hits most of the gun shows around the area as he just likes to buy and sell. I would have went this route but the deal on this package is what I was looking for. Just have to exercise some patience which is not exactly my strong suit.

    waytogo I keep reading this and it baffles me to a degree. I might get a quick check to see if things changed, but guess I was under the impression that what these 2 documents where for. doah

    I have no desire to purchase any more guns, thought of maybe a pistol of some sort but nixed that a while back. I’m almost 65, haven’t really came across an event where I needed or wanted one, so …

    former military, and this is what happens to me…anymore i just expect to submit the purchase and come back in 3 days to actually pick it up. i’m about to buy a new truck carry, and a side effect of this system is i’ve become much more likely to seek out private sales instead.

    John, I had never been delayed before and about this time last year I was delayed at the same store you are talking about. It was just an odd system deal and it ended up being delayed for 30 days in NICS and then re-applied and it went thru right away. SW has a policy that they wont sell until they get an approved where some smaller retailers will let is go out the door without a response in 5 or 7 days. I like the staff at that location it just seems to be a paperwork/NICS hassle sometimes. I have one on its way to that store later this week also…

    huh, never heard of that before. The law is if they don’t get a deny in three business days they can transfer it. I suppose they can do whatever they want but when I’ve been delayed I just planned on going back in three days because it would either be approved or not have a response and didn’t matter which.

    Reef, I have never been delayed before that so I didn’t remember how many days it was (3, 5, or 7) but regardless they were not letting it out the door without an approve. I imagine big box attorneys and the potential merge with BPS last year may have had things fairly restrictive in the policy department. As I said 30 days went by, I re-applied and it went right thru that day…

    Buy at fleet farm. It’s the only place besides my local shops that I don’t get a hold. Gander every time, sportsmans everytime, Walmart everytime even for rifles and shot guns

    I’m former military, and had a top secret clearance to boot. I have never waited over 5 min for an approval, and I have purchased alot over the years, but nothing but private in the last 5 years. My wife has purchased two in the last 3 years, and those were also less than 5 min for approval. Guess wife and I were just lucky, but based on my security clearance, not sure that that affects anything.
