Anyone deal with evictions?

    I have a some questions. If you have knowledge on evicting a non renter with no lease I could use some guidance. A quick Google search 30 days with a written notice.

    Get a legal written eviction letter. It’s a ugly battle, brother did that with a ex that wouldn’t leave his house and court sided with her due to her mail going to that residence. It was a ugly battle. And I thought it was 90 days and not 30

    Talk to the Sheriff and/or a lawyer. Good chance you will need both.

    I just stopped at every lawyer in town and none of them deal with evictions and none had anyone to refer me too.

    Not if they are a resident. This state protects the Tennant before the landlord. Especially before winter.

    Not trespassing. After enough time a ‘guest’ legally becomes a ‘tenant’. Only been involved from a foreclosure/REO standpoint so not much help. Looked at kicking a live in girlfriend out a time or two when I’ve gotten upset enough and from what I could tell it would be at least a 90 day process (in MN). Let’s just say I’ve kept her around…

    Does the tenant pay anything? On what pay period?(weekly, monthly,etc)

    In MN a non-lease tenant is able to be given notice at the end of the previous pay period to be out by the next. So for month to month you’d have to give 30 days, week to week it 7, etc. Not sure on the non-paying part however. You may be able to boot them immediately but only you know the details of your agreement.

    Serve them a letter that states they need to be out in 30 days. If they are not out in 30 days, you can start the eviction process through the courts.

    Once there is a court order from a judge, law enforcement could then remove them. Unfortunately, this is not a quick process but it needs to be started with a letter from you.
